9. WARRANTY
- The warranty period for most products is six months from the invoice date, unless specified otherwise. We will repair these products free of charge during this period. If you're outside the UK, you'll need to send the product back to STARLAB UK for free repairs. In some cases, we may ask you to send the product to our Service Laboratory in Milton Keynes. We'll cover the cost of spare parts and labor if they're defective. Please note that this warranty doesn't cover damage caused by misuse or factors other than defective manufacture or materials. Unauthorized repairs without our written consent void the warranty.
- The warranty periods for STARLAB UK brand products are as follows:
- Manual pipettes: 36 months
- Replacement parts: 12 months
- Refurbished products have a one-year warranty unless stated otherwise in writing by STARLAB UK.
- Please refer to the warranty/service information on our website's homepage and any warranty papers provided with your product.
- When sending products for repair or service, please understand that we cannot be held liable for any damage that may occur. Make sure to send the product with prepaid shipping and clearly label it with your name and address. Additionally, include a letter specifying the required work. To initiate an official repair or service, please contact STARLAB UK to place an order.
10. DEMONSTRATION PRODUCTS
Unfortunately, sample packs or demonstration products cannot be purchased directly from the website. If you're interested in requesting them, please send an email to your Account Manager.
11. INSTALLATION
The prices listed for products at STARLAB UK generally don't include installation, demonstration, or training unless mentioned otherwise. However, you can request these services separately. If you've already discussed installation, demonstration, or training with STARLAB UK, please make a note of it when placing your order for the products.
12. LIABILITY
STARLAB UK only supplies the products to businesses.
- Nothing in these conditions limits or excludes STARLAB UK’s liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession); or
- defective products under the Consumer Protection Act 1987.
- Subject to paragraph 12 (b), STARLAB UK will under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the supply of the products for:
- any loss of profits, sales, business, or revenue;
- loss or corruption of data, information or software;
- loss of business opportunity;
- loss of anticipated savings;
- loss of goodwill; or
- any indirect or consequential loss.
- Subject to paragraph 12 (b), STARLAB UK’s total liability to you in respect of all losses arising under or in connection with the supply of the products, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the products.
- Except as expressly stated in these conditions, STARLAB UK does not give any representation, warranties or undertakings in relation to the products. Any representation, condition or warranty which might be implied or incorporated into these conditions by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, we will not be responsible for ensuring that the products are suitable for your purposes.
13. ARBITRATION
If any disagreement or issue arises related to these conditions, it will be resolved by appointing a single arbitrator, following the guidelines of the Arbitration Act 1996 or any applicable laws in effect at that time.
14. FORCE MAJEURE
If there are delays in delivering your order due to circumstances like natural disasters, strikes, accidents, or any other events beyond STARLAB UK's control (including issues with raw material availability or price increases), we'll do our best to provide a reasonable extension of time.
15. NOTICES
If you need to send any notices to STARLAB UK, make sure it's in writing. You can either deliver it by hand or send it through first class recorded delivery or registered post. Address it to STARLAB UK at the following address: STARLAB (UK), LIMITED. Unit 5, Tanners Drive, Blakelands, Milton Keynes, Bucks, MK14 5BU.
- If you choose to deliver the notice by hand, it will be considered received on the date of delivery. If you opt for first class recorded delivery or registered post, it will be deemed received when the postal authorities confirm its receipt.
16. LEGAL CONSTRUCTION
The agreement between STARLAB UK and you, the Buyer, for the supply of products will be governed by English Law.
17. GENERAL
- STARLAB UK can transfer our rights and responsibilities to another organization, but it won't affect your rights or our obligations under these conditions.
- You can only transfer your rights or obligations under these conditions to someone else if STARLAB UK agrees in writing.
- The contract is between you and STARLAB UK. No other person has the right to enforce its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
- Each paragraph of these conditions is separate. If any court or authority finds any of them unlawful or unenforceable, the remaining paragraphs will still be valid.
- If we don't insist that you fulfill your obligations or if we don't enforce our rights against you, it doesn't mean we've given up our rights or that you don't have to comply. If we do waive a default by you, we'll only do so in writing and it won't automatically mean we waive any future defaults.
- You and we both agree that, except as stated in paragraph 13, any dispute or claim related to the contract or its subject matter will be settled exclusively in the courts of England and Wales.
