The participants grant SCRIVO Public Relations and STARLAB the irrevocable, spatially, unlimited in time and content, non-exclusive and gratuitous rights of use for all known and unknown types of use (in particular, public access, reproduction and dissemination) of the pictures or images and audiovisual content produced by on order of Starlab submitted by them for the purpose of participating in the campaign “Colours of Science 2022”, reporting on it (regardless of the media), for the public relations for the campaign, as well as the right to assign the execution of these rights to third parties.

Terms and Conditions.

§ 1 General  

The organizer of the campaign “Colours of Science 2022” on the occasion of the World Day of the Laboratory is SCRIVO Public Relations GmbH, Lachnerstr. 33, 80639 Munich, Germany in Name of the STARLAB International GmbH, Neuer Höltigbaum 38, 22143 Hamburg, Germany. Hereinafter referred to as “SCRIVO” and “STARLAB”.   By participating in this campaign “Colours of Science 2022”, entrants agree to the following conditions:

(1) Participation in the campaign “Colours of Science 2022” is free of charge and not linked to a purchase obligation and/or use of services. A purchase or use of services will not improve your chances of winning. Mere participation does not entitle a participant to win a prize.  
(2) This contest is open only to those who are over the age of 18 located in a country in which STARLAB products are sold (see www.starlab.click/worldwide).  
(3) For participation in the campaign and in the prize draw all personal data must be entered truthfully. The participant is responsible for the accuracy of the submitted data.  
(4) Legal representatives, employees of the organizer as well as their relatives and third persons being somehow related to this campaign “Colours of Science 2022” are excluded from participation.    
(5) SCRIVO reserves the right to disqualify any individual from the campaign “Colours of Science 2022” on the grounds of violation of the eligibility requirements. Anyone using illegal means or other manipulation to gain advantage shall also be disqualified. In these cases, prizes can also be subsequently disallowed and reclaimed, as necessary. SCRIVO reserves the right to reject submissions at any time without giving reasons; this refers in particular to submissions that are morally, ethically, or legally inacceptable.     

§ 2 “Colours of Science 2022” period and description

(1) The campaign “Colours of Science 2022” begins on March 9th 2022 at 8:00 AM CEST and ends on March 16th 2022 at 11:59 PM CEST.  
(2) Participation in the campaign “Colours of Science 2022” To take part in the campaign “Colours of Science 2022”, participants must send an inspiring story via email at marketing@starlab.de and briefly explain their inspirational story.   Only one entry per person. In the case of multiple entries, the first submitted story (email) will be taken. By entering the competition, the participant accepts the Terms and Conditions of the campaign “Colours of Science 2022” of SCRIVO and SCRIVO will contact every participant. (3) The winners will be notified via email within 10 days after the end of the contest.   

§ 3 Prizes  

Among the participants SCRIVO raffles one The Westin Hamburg voucher worth 500 EUR. Please note the specification of the prizes will be determined by SCRIVO. SCRIVO reserves the right to change the prize at any time.
(4) All prizes are non-redeemable for cash. Winners cannot make claim to cash payment of the price or exchange of the prize for another item.
(5) Prizes are non-transferable to another person but the winner.
(6) The delivery will be organized by SCRIVO Public Relations. If delivery of the prize to the winner is not possible, and if it is therefore sent back to the organizer, a new delivery will only be organized on request of the winner. The winner is in default of acceptance and must bear the costs for the renewed shipment.  
(7) If the prize cannot be delivered within three months of electronic notification for reasons that lie with the winner, SCRIVO cannot guarantee that the original prize is still available. The winner will then receive a replacement of more or less the same value. The winner will also receive a replacement of more or less the same value if the original prize is no longer available in the presented design (model change, seasonal goods etc.). The winner accepts necessary changes of the prize if they are due to causes that are out of control of the companies involved in the campaign “Colours of Science 2022”. If the prize cannot be delivered within six months of electronic notification due to reasons that lie with the winner, the claim to the prize is forfeited. In this case, SCRIVO reserves the right to draw another winner.  
(8) Delivery is free within Europe. Freight costs and customs that may incur in addition must be borne by the winner. In this case, the seat of the organizer remains the place of performance.  

§ 4 Publication of winners

By participating in the campaign “Colours of Science 2022”, participants explicitly agree that the names of the winners (with the last name abbreviated, if desired) may be printed/included in the following: on the STARLAB website at www.starlabgroup.com on STARLAB owned company pages in social networks such as Facebook, LinkedIn, Twitter, Pinterest and Instagram. In following issues of our newsletter or other similar STARLAB promotional publication.  

§ 5 Copyright

By entering the competition, participants, explicitly agree that in case they win the prize their name and photo (with the last name abbreviated, if desired) could be printed in the next Newsletter publication, announced on social media (as detailed above), or on the STARLAB local European websites. Participants release STARLAB and SCRIVO from possible third party claims due to the violation of such rights and possible legal costs. STARLAB and SCRIVO have the right to edit (in particular electronic online editing), reproduce, and communicate by other medial means as well as transfer these rights to third parties. Future uses are free of charge. Participant will waive any further right against STARLAB and SCRIVO.  
The participants grant SCRIVO Public Relations and STARLAB the irrevocable, spatially, unlimited in time and content, non-exclusive and gratuitous rights of use for all known and unknown types of use (in particular, public access, reproduction and dissemination) of the pictures or images submitted by an produced with them for the purpose of participating in the campaign “Colours of Science 2022”, reporting on it (regardless of the media), for the public relations for the campaign, as well as the right to assign the execution of these rights to third parties.  
The participant may object to the use of the images or videos, audio content submitted by or produced with him/her in the context of the raffle submitted as part of the competition at any time in writing or by e-mail to marketing@starlab.de contradict, as long as the campaign runs. The objection has the consequence that the contribution submitted by the objector up to this point will be deleted from the site and the participant will no longer take part in the competition.    
Each participant assures that he or she owns all rights to the submitted pictures or videos, that he or she has the unrestricted rights of use and exploitation of all parts of the video, that the pictures or videos are free from third party rights, and that no personal rights are violated in the depiction of persons. In particular, the participant guarantees that the rights of all persons depicted in the uploaded image or video are respected, in particular the right to one's own image, and that they have granted themselves the corresponding rights to use and have been granted the corresponding rights of use and dissemination. The participants indemnify the organizer from all the aforementioned rights and claims of third parties. This also applies to the costs of legal prosecution and claims for damages.

§ 6 Premature termination of the campaign "Colours of Science 2022"

SCRIVO reserves the right to terminate the of the campaign "Colours of Science 2022" at any point in time without prior notice and without giving reason. SCRIVO will make use of this possibility especially if proper execution of the campaign "Colours of Science 2022" cannot be ensured due to technical reasons (e.g. viruses in the computer system, manipulation, or hard- and/ or software errors) or legal issues. If premature termination is caused by a participant’s behaviour, SCRIVO may claim damages.   

§ 7 Rejection of the submitted data

SCRIVO reserves the right to reject submissions by the participants at any time without giving reasons; this refers in particular to data that is morally, ethically, or politically inacceptable.     

§ 8 Data Protection

By participating in the contest, each participant grants to SCRIVO the right to store and use his/her personal data for the purposes of administering the contest including, but not limited to, contacting and announcing the winners and fulfilling the award of the prizes (including postage). The participant can withdraw the consent to the storage/use of data and, consequently, withdraw participation at any time.  
The winner can revoke his consent to temporary data storage at any time after the competition has been held. The revocation must be sent by e-mail to office@scrivo-pr.de. After revocation of the consent, the collected and stored personal data of the winner will be deleted immediately. The storage of the data is temporary. All data of the winner will be completely deleted, even without revocation, at the latest one year after the execution of the competition, as far as this is within the possibilities of the organizer and the company (not on Facebook, etc.).   

§ 9 Liability

Through the delivery of the prizes, SCRIVO is free of all legal obligations, provided that an earlier time does not arise from these provisions. SCRIVO accepts no responsibility for lost, wrongly delivered, damaged, or illegible participant information, errors, omission, interruptions, deletion, defects or delays in sending data, theft or damage, as well as unauthorized access to or changes in participant details, all technical, network, telephone, electronic, computer, internet, hard- and software disruptions, erroneous transmittance or failed receipt of access information due to technical problems, e.g. internet overload, damage to the participant’s computer and to any other person due to participation in the contest.   

§ 10 Rejection of Legal Action / Applicable Law and Jurisdiction / Others

Legal recourse is prohibited. Exclusively law of the Federal Republic of Germany shall be applicable. Court of Jurisdiction is Munich / Germany. If any of these terms are or become invalid, the validity of the remaining terms shall not be affected. Version: March 7, 2022 SCRIVO Public Relations
